TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of Hausios.

Hausios is provided by SLADURADA Ltd. (“SLADURADA”, “we”, “us” or “our”).

By creating a Hausios account or using Hausios, you agree to these Terms. Please read them carefully before using the service.

If you do not agree to these Terms, you should not create an account or use Hausios.

Hausios is intended only for adults aged 18 or over.

1. ABOUT HAUSIOS

Hausios is a software service that provides renters and housing providers with a shared workspace for organising information relating to a potential or ongoing rental.

A Rental Case may contain property information, rental context, participants, invitations, status information and a history of important actions.

Hausios provides software and technical infrastructure only.

Hausios is not:

• a landlord or housing provider;
• a tenant or renter;
• a real-estate agent;
• a property broker;
• a property manager;
• a rental marketplace;
• a legal adviser;
• a financial adviser;
• an insurance provider;
• an identity-verification service;
• a property-verification service;
• a guarantor; or
• a party to any rental or lease agreement between users.

SLADURADA Ltd. does not enter into rental agreements on behalf of users and does not represent either participant in a Rental Case.

Any rental relationship, negotiation, agreement or transaction is solely between the relevant users.

2. ELIGIBILITY

You must be at least 18 years old to create an account or use Hausios.

By creating an account or using Hausios, you represent that you are legally capable of entering into these Terms.

You may not use Hausios if your use of the service would violate applicable law.

3. ACCOUNTS

You must provide accurate information when creating and maintaining your Hausios account.

You are responsible for maintaining the security of your account and authentication credentials.

You must not:

• create an account using another person's identity without authorisation;
• impersonate another person;
• provide deliberately false or misleading account information;
• allow another person to misuse your account; or
• attempt to gain unauthorised access to another user's account.

If you believe your account or credentials have been compromised, you should take reasonable steps to secure the account and contact us at info@sladurada.com.

4. RENTAL CASES

A Rental Case is a shared software workspace.

It is intended to help participants organise information relating to a rental.

A Rental Case does not itself constitute:

• a rental agreement;
• a lease;
• a reservation;
• a booking;
• an offer or acceptance of a property;
• proof of ownership;
• proof of identity;
• proof of authority to rent a property;
• a legally binding property inspection;
• a guarantee that a rental will proceed; or
• a guarantee concerning any participant or property.

Statuses, timeline entries, invitations and other actions recorded within Hausios describe activity within the software.

They should not by themselves be interpreted as creating a rental contract or determining the legal rights or obligations arising from a rental relationship.

Users are responsible for determining whether separate agreements, documentation, verification or professional advice are required for their rental.

5. USER INFORMATION AND RESPONSIBILITY

Users are responsible for information they enter into Hausios.

This includes information concerning:

• themselves;
• properties;
• rental terms or expectations;
• addresses;
• descriptions;
• expected rent;
• other participants; and
• Rental Cases.

You should only provide information that you reasonably believe is accurate and that you are entitled to provide.

You must not knowingly provide false, fraudulent or materially misleading information.

Hausios does not independently verify user-submitted information unless we expressly state otherwise for a specific feature.

You are responsible for reviewing information relevant to you before relying on it or making decisions based on it.

6. PROPERTY AND PARTICIPANT VERIFICATION

Hausios does not currently independently verify:

• a participant's identity;
• whether a person owns a property;
• whether a person is authorised to rent or offer a property;
• the physical existence or condition of a property;
• property addresses;
• rental prices;
• financial circumstances;
• creditworthiness;
• employment;
• references;
• legal documents; or
• statements made by another user.

The appearance of information in Hausios does not mean that SLADURADA Ltd. has verified, approved or endorsed that information.

You are responsible for performing any checks you consider appropriate before entering into a rental arrangement or relying on information supplied by another person.

7. INVITATIONS

Hausios allows either a renter or a housing provider to create a Rental Case and invite the other participant.

If you provide another person's email address for this purpose, you must have an appropriate and lawful reason to provide and use that address for the invitation.

You must not use Hausios invitations for:

• spam;
• unsolicited marketing;
• harassment;
• mass messaging;
• fraudulent activity; or
• purposes unrelated to legitimate use of Hausios.

An invitation does not create a rental agreement and does not require the recipient to join Hausios or proceed with a rental.

Recipients remain free to accept or disregard an invitation.

8. SHARED INFORMATION

A Rental Case is designed to be shared between its participants.

Information added to a Rental Case may be visible to the other participant in that case.

You should not add information to a Rental Case that you are not comfortable sharing with the relevant participant.

You must not use Hausios to disclose information about another person where you do not have an appropriate basis or right to do so.

Please do not enter unnecessary sensitive personal information, including identity-document numbers, banking credentials, health information or similar sensitive information, into property descriptions or other free-text fields.

9. ACCEPTABLE USE

You may use Hausios only for lawful purposes and in accordance with these Terms.

You must not use Hausios to:

• commit or facilitate fraud;
• impersonate another person;
• misrepresent your identity or authority;
• harass, threaten or abuse another person;
• send spam or unsolicited marketing;
• distribute malware or malicious code;
• attempt to bypass authentication or access controls;
• obtain unauthorised access to accounts, systems or data;
• probe, scan or test vulnerabilities without our written authorisation;
• interfere with the operation or security of Hausios;
• deliberately overload or disrupt the service;
• scrape or systematically extract information in a manner that harms the service or other users;
• use automated systems to abuse the service;
• infringe intellectual-property rights or other legal rights;
• upload or provide unlawful content;
• use Hausios for activity that violates applicable law; or
• assist another person in doing any of the above.

You must not attempt to circumvent technical restrictions or security measures used to protect Hausios or its users.

10. USER CONTENT

You retain any rights you may have in information and content that you provide through Hausios.

You grant SLADURADA Ltd. a non-exclusive licence to host, store, reproduce, process, transmit and display that content only to the extent reasonably necessary to:

• provide Hausios;
• make shared Rental Case information available to authorised participants;
• operate invitations and other requested features;
• maintain and secure the service;
• troubleshoot technical problems; and
• comply with applicable legal obligations.

This licence does not transfer ownership of your content to SLADURADA Ltd.

You are responsible for ensuring that you have the rights necessary to provide content to Hausios.

11. INTELLECTUAL PROPERTY

Hausios, including its software, interface, branding, visual design, original content and associated intellectual property, is owned by or licensed to SLADURADA Ltd., except for content provided by users or third parties.

These Terms do not transfer ownership of Hausios or its intellectual property to you.

You may use Hausios only as permitted by these Terms and applicable law.

You must not copy, reproduce, distribute, sell, sublicense or commercially exploit protected elements of Hausios except where permitted by law or with our prior permission.

12. FREE SERVICE

Hausios V1 is currently provided without subscription fees, transaction fees or commissions.

Hausios does not currently process rental payments or collect money on behalf of renters or housing providers.

The fact that Hausios is currently provided without charge does not mean that every future Hausios feature or version will necessarily be free.

If paid functionality is introduced in the future, applicable pricing and additional terms will be presented before a user becomes obligated to pay.

We will not retroactively charge you for use that was provided as free.

13. THIRD-PARTY SERVICES

Hausios relies on third-party infrastructure and service providers to operate parts of the service.

These may include hosting, database, authentication and email-delivery providers.

The availability or performance of Hausios may therefore sometimes depend on systems outside our direct control.

Third-party services may also be subject to their own terms, privacy practices and technical limitations.

Our use of personal information and service providers is described further in the Hausios Privacy Policy.

14. SERVICE AVAILABILITY

We aim to provide a reliable service, but Hausios is not guaranteed to operate without interruption, delay or error.

The service may occasionally be unavailable because of:

• maintenance;
• updates;
• technical failures;
• security incidents;
• third-party infrastructure failures;
• network problems; or
• circumstances outside our reasonable control.

To the extent permitted by applicable law, we do not guarantee uninterrupted or error-free availability.

Nothing in this section limits any mandatory rights you may have under applicable law concerning the supply or conformity of a digital service.

15. CHANGES TO HAUSIOS

We may modify, improve or replace features as Hausios develops.

We may also discontinue functionality where reasonably necessary, including for technical, security, legal or operational reasons.

Where a change materially affects users' contractual rights or the continued use of the service, we will provide notice where required by applicable law.

Nothing in these Terms removes any mandatory rights or remedies you may have in relation to changes to a digital service.

16. SUSPENSION AND RESTRICTION

We may restrict or suspend access to Hausios where reasonably necessary to:

• protect users or the service;
• investigate suspected fraud or security abuse;
• prevent unlawful activity;
• respond to a material violation of these Terms;
• comply with a legal obligation; or
• protect the integrity of Hausios.

Where appropriate and reasonably possible, we may provide notice or an opportunity to address the issue.

We will not exercise these rights in a way that overrides mandatory rights available to consumers under applicable law.

17. ENDING YOUR USE OF HAUSIOS

You may stop using Hausios at any time.

Hausios V1 does not currently provide automated self-service account deletion.

If you wish to make a request relating to your account or personal information, you may contact info@sladurada.com.

Certain information may form part of a shared Rental Case or its history and may therefore be subject to retention or other requirements described in the Privacy Policy and applicable law.

Stopping use of Hausios does not automatically erase all information previously associated with a shared Rental Case.

18. USER RELATIONSHIPS AND DISPUTES

Hausios provides a shared software workspace but does not control the relationship between renters and housing providers.

SLADURADA Ltd. is not responsible for negotiating or resolving rental disputes between users.

Users are responsible for their own:

• communications;
• representations;
• negotiations;
• rental decisions;
• property checks;
• identity checks;
• agreements;
• legal compliance; and
• disputes with other participants.

If a dispute concerns a rental, property, payment, deposit, possession, contract or another user's conduct outside the operation of the Hausios software itself, the dispute is between the relevant users or other responsible parties.

Nothing in these Terms prevents a user from exercising rights available under applicable law.

19. NO PROFESSIONAL ADVICE

Information, interface text, statuses, workflows and other content provided through Hausios are intended to support organisation of a Rental Case.

They are not legal, financial, tax, property, insurance or other professional advice.

You should obtain appropriate independent professional advice where necessary.

20. DISCLAIMER

Hausios is provided as a software service.

To the maximum extent permitted by applicable law, we do not make guarantees concerning:

• the identity, honesty or reliability of another user;
• the ownership, legality, availability, quality, condition or suitability of a property;
• the accuracy of information supplied by users;
• whether a rental will proceed;
• whether another participant will perform an agreement;
• the outcome of negotiations or disputes; or
• matters outside the operation of the Hausios software.

You remain responsible for evaluating other users, properties, information and rental decisions.

Nothing in these Terms excludes warranties, obligations or consumer protections that cannot lawfully be excluded or limited.

21. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

In particular, these Terms do not exclude or limit liability for matters that cannot lawfully be excluded or restricted under applicable consumer law.

Subject to those mandatory rights and to the maximum extent permitted by applicable law, SLADURADA Ltd. is not responsible for losses caused solely by:

• false or inaccurate information supplied by another user;
• conduct of another renter, housing provider or third party;
• a user's independent rental decision;
• a rental agreement to which SLADURADA Ltd. is not a party;
• property defects or misrepresentations not caused by SLADURADA Ltd.;
• disputes between Rental Case participants;
• misuse of Hausios contrary to these Terms; or
• circumstances outside our reasonable control.

Where applicable law permits limitations of liability, any limitation will apply only to the extent that it is fair, reasonable and legally enforceable in the circumstances.

Nothing in this section limits statutory remedies available to consumers for a failure by us to provide the Hausios digital service as required by applicable law.

22. INDEMNITY FOR UNLAWFUL MISUSE

To the extent permitted by applicable law, if you use Hausios in deliberate violation of these Terms or applicable law and that misuse directly causes a third-party claim, regulatory action, damage or reasonable cost to SLADURADA Ltd., you may be responsible for the resulting loss to the extent legally attributable to your conduct.

This provision does not require a consumer to compensate SLADURADA Ltd. for matters caused by SLADURADA Ltd., for the lawful exercise of consumer rights, or where such an obligation would be unfair or unenforceable under applicable law.

23. PRIVACY

Our processing of personal information is described in the Hausios Privacy Policy.

The Privacy Policy explains what information Hausios processes, how it is used and shared, the service providers involved, retention considerations and privacy rights.

The Privacy Policy forms an important part of understanding how Hausios operates, but acknowledgement of the Privacy Policy is not treated as consent to processing where applicable law requires a separate consent.

24. CHANGES TO THESE TERMS

We may update these Terms when Hausios changes or where changes are reasonably necessary for legal, security, technical or operational reasons.

The updated Terms will show a revised “Last updated” date.

Where a change materially affects your rights or obligations, we will provide appropriate notice where required by applicable law.

Where applicable law requires your agreement to a change, we will request it rather than treating continued use alone as sufficient acceptance.

Changes will not remove mandatory rights that arose before the change.

25. APPLICABLE LAW AND CONSUMER RIGHTS

These Terms are governed by the laws applicable to SLADURADA Ltd., subject to mandatory consumer-protection rules that may apply based on your country of residence or other applicable law.

Nothing in these Terms deprives you of protections that cannot legally be waived or restricted by contract.

If you are a consumer in the European Union or another jurisdiction that provides mandatory consumer rights, you retain those rights.

26. DISPUTES WITH SLADURADA LTD.

If you have a concern about Hausios itself, we encourage you to contact us first at info@sladurada.com so that we can try to understand and resolve the issue.

Nothing in these Terms restricts your right to bring a claim before a competent court or to use another dispute-resolution mechanism available to you under applicable law.

These Terms do not impose mandatory arbitration or waive any right to bring proceedings where such a restriction would be prohibited or unenforceable.

27. SEVERABILITY

If a provision of these Terms is found to be invalid or unenforceable, that provision will apply only to the extent it can lawfully be applied.

Where appropriate, the remaining provisions will continue to apply.

Nothing in this section permits an invalid or unfair consumer term to be rewritten in a way that deprives a consumer of mandatory protections.

28. ENTIRE TERMS

These Terms, together with any additional terms expressly presented for a specific Hausios feature, constitute the terms governing your use of Hausios.

The Privacy Policy separately explains how personal information is processed.

Nothing in this section excludes representations or rights that cannot lawfully be excluded.
